&&为了进一步提升仲裁质量，提高仲裁社会公信度，成都仲裁委在成立15周年之际，首次通过本报发布指导性案例，为市民的经济活动提供法律借鉴和参考。&&案例3&&同一公司两车互撞 交强险也要赔&&去年1月，成都同一出租车公司名下的一辆捷达出租车和一辆爱丽舍出租车相撞，交警认定捷达车负全责。出租车公司曾以自己的名义对两车都投保了交强险和三者险，因此于事发后向保险公司报案申请理赔。但保险公司提出，交强险和三者险都是赔偿因交通事故给第三人造成损害的，而这起交通事故中受害、肇事车都属同一公司，因此不在赔偿范围。出租车公司为此向成都仲裁委申请仲裁。&&“只赔第三者的损失，而不赔投保人和被保险人的损失，是为了防止骗保事件的发生。”仲裁委认为，但保险公司并没有证据证明这起交通事故是骗保行为。&&&&此外，“一般来讲车辆受损都是赔给车主，而该案因为有承包协议实际是赔给司机。”仲裁员说，根据出租车公司与司机的承包协议，承包期间司机承担车辆的一切运营风险。因此，此案实际上是出租车公司作为捷达车车主对爱丽舍车司机造成损害，应属于对第三者造成损害。综上，保险公司应当赔偿出租车公司约2万元。&&案例4：&&二手车过户 保险请同步变更&&周强（化名）从朋友处买了辆二手车。此前朋友已买了三者险而期限未到，周强就没有再买保险，但怕麻烦又没有到保险公司将保险变更到自己名下。可他不久后就驾车将黄女士撞伤并赔偿了5000元，周强为此拿着签名仍是其朋友的三者险合同找保险公司理赔，但保险公司认为周强不能依据其朋友的合同来理赔，周强遂将保险公司告上仲裁庭。&&日前，成都仲裁委裁决驳回周先生全部仲裁请求。仲裁委认为，三者险合同是对车辆的保险，也是民事合同的一种，它只能约束订立合同的当事人。因此，周强即使买了这辆车，不是保险合同的当事人。&&仲裁员提醒，市民买二手车后，除了在车管所办理车辆过户手续外，还应该完成其他相关手续的变更，以免今后的麻烦。成都仲裁委 成都商报记者 李凌鹏
