出租房漏水楼下邻居遭殃

楼上房屋漏水，搞得自己家里一团糟，南京市民吴强想维权，却遭遇扯皮。原来楼上是个出租房，房主和房客踢起了皮球。最后经过警方协调，房主赔偿了吴强的损失。律师表示，对于此类纠纷，除非房主能证明是房客的过错，否则应由房主担责。
　　吴强家住南京夫子庙附近，最近他遇到了烦心事，楼上房屋天天漏水，搞得他家的房顶、墙壁甚至地面都是湿的。家里几乎成了“水帘洞”。见此情况，吴强找到楼上的住户，但跑了几次，漏水问题也没有得到解决，家中维修更是无人问津。原来，楼上的房主已经将房子出租了，而租客认为房子漏水是房屋老化造成的，不是他的原因。所以，他每次连门都不开，直接让吴强去找房主。几次交涉下来，吴强通过租客拿到房主的电话后，联系上了房主李明。一开始，对于吴强所说的问题，李明很是积极，双方还约定时间谈维修和赔偿问题。但没想到，到了约定时间，李明并没有出现。吴强再次联系李明时，李明却换了一副嘴脸，“房子我已经租出去了，漏水肯定是租客个人原因造成的，和我没关系，你找租客吧!”李明也将自己的责任推得一干二净。就这样，在房主和房客的推诿下，漏水问题一个星期都没有解决。无奈之下，吴强报警求助。
　　夫子庙派出所民警接警后，第一时间到现场查看，此时吴强家的墙壁上已经十分斑驳，有的地方墙皮都快脱落，必须立即找人解决漏水问题，不然家中的装饰要毁掉一大片。就此情况，民警也找到了李明，经过多次交谈，终于说动李明到现场处理。李明在看了吴强家的情况后，本还想推诿的却有些不好意思了。这时，民警表示，他已经联系好了施工队，可以先维修后收费。有了这个台阶，李明当即答应出钱维修。经过一天时间的施工，漏水问题终于得到了圆满解决。前天，吴强拨打了“12345”热线，对夫子庙派出所进行表扬。
　　“像这样的邻里纠纷，我们经常会遇到，处理起来确实也蛮棘手的。”民警表示，房主和房客究竟谁该担责，有时候还真说不好。对此，江苏圣典律师事务所唐迎鸾律师表示，作为楼下的住户来说，楼上漏水了，那么楼上的房主肯定是首要的追责对象。如果房主有证据证明漏水是房客的原因造成的，那么相应的维修、赔偿费用由房客承担，否则都由房主承担。(文中人物系化名)

房东房客官司打一年，扯的是――出租房漏水该谁来修复

　　房屋在出租期间出现漏水，究竟应该由谁来负责修复，租房者和房东各执己见，互不相让，将官司打到了法院。近日，云岩区法院对这样一起案件作出判决。
　　日，王某某与何某某、蒋某某签订《房屋租赁契约》，以每月40000元价格租用位于云岩区的1028.13平方米房屋。该房实际上是由某保安有限公司使用，租赁期限为日起至日止。协议中约定，合同期间任何一方没有合理理由终止合同，将付违约金30万元。
　　在出租房屋过程中，由于房屋漏水双方发生纠纷，王某某诉至法院，日，云岩区法院曾一审判决，原、被告及第三人均不服上诉至贵阳市中级人民法院。贵阳市中级人民法院发回重审。
　　●入住不久下雨就漏水
　　重审中，王某某称，契约签订后入住不久原告发现该房每逢下雨室内到处渗水，导致房屋部分垮塌，影响了保安公司的经营活动。多次电话及书面通知何某某与蒋某某要求其对出租房进行修缮，但对方一直未予维修，保安公司现已搬出该租赁房。
　　而何某某、蒋某某则称，他们交付给原告的房屋情况良好符合约定，房屋漏水存在第三方侵权、原告使用不当等情况，对于原告所说房屋垮塌不属房屋租赁合同范围内，对此部分被告没有修缮的义务，应驳回原告的诉讼请求。
　　●司法鉴定漏水并非装修所致
　　重审期间，云岩区法院委托省建筑科学研究检测中心司法鉴定中心，对房屋渗水原因进行鉴定，于4月24日出具了鉴定意见，认为：该房屋有明显的漏水痕迹，表明其曾经漏水，漏水原因是变形缝处防水功能失效。两名鉴定人出庭作证，进一步解释称，可以排除后期建筑物装修施工原因所致。
　　●法院判决：房东有义务保障房屋质量
　　云岩区法院认为，根据合同约定，何某某、蒋某某应对房屋及附属设施质量问题进行修缮，也有义务提供质量完好的房屋及附属设施给承租人使用。何某某、蒋某某提供的房屋存在变形缝处防水功能失效，导致漏水，也未对房屋渗水进行及时的修缮，导致《房屋租赁契约》提前解除，何某某、蒋某某应赔偿威盾公司造成的损失，但该房屋渗水是否导致合同完全不能履行，保安公司未充分举证，法院酌情判令何某某、蒋某某赔偿保安公司装修损失%＝元，其余部分不予支持。
　　根据合同约定违约金300000元是对任何一方无理终止合同的惩罚，本案中提出终止合同的系保安公司，且已判令何某某、蒋某某赔偿损失，对该违约金请求不予支持。
　　对于威盾公司已交一年租金人民币480000元及押金人民币40000元，因双方签订的房屋租赁合同是日起，保安公司实际使用该房屋至日，保安公司尚未使用的四个半月的房屋租金180000元及押金40000元何某某、蒋某某予以退还。
　　云岩区法院依法判决：何某某、蒋某某一次性返还贵州某保安有限公司房屋租金180000元、押金40000元以及支付装修补偿费元。
