我是施工单位的预算和资料员，我3月份到一家私人施工单位上班，工资和工作都是口头说明，没有签合同，我的工资为每月5000元。因为公司不发工资和老板的刁蛮，我决定在公司不想干了，我于7月8日想公司借15000，我如果借钱我继续在公司干，如果不借或者少借，我就辞职不干了，结果老板只借5000元，7月10日我才借到5000元，我于7月12日请假说家里有事，就回家在家里做些其他事情，我在7月15日电话告知公司主管领导，我不上班了，让公司另外请人，我决定公司不上班了，公司也不想去，剩余工资也不想要了，因为公司老板太蛮横不讲理，我在也不想见他。但是今天公司发信息说，我如果在7月31日前上班或到公司移交手续，如果不来公司上班或移交手续。公司要到法院起诉我，我知道移交手续只是公司的一个策略，我知道没有移交的手续，我咨询一下公司起诉我够条件吗
