原标题:118次审判、14万页证据 韩检方:朴槿惠应受严惩
  据《韩民族日报》报道,韩国前总统朴槿惠“干政案”的一审庭审在检方30年有期徒刑的求刑下,暂时告一段落。检方认为,作为由“政经勾结”犯罪造成的干政事件最终责任人,朴槿惠必须受到严惩。
  118次庭审、14万页证据记录 检方强调严厉处罚
  当地时间2月27日下午,在韩国首尔中央地方法院刑事22部进行的朴槿惠案的最终辩论中,检方用24分钟,根据118次庭审、130余次询问证人和14万页的证据记录,逐条指出了能证明朴槿惠犯下了包括受贿及索贿592亿韩元等在内的18项罪名的证据。
  随后,检方举出了必须严惩的理由,包括朴槿惠破坏宪法价值、进行政经勾结、将民间企业私有化,实行文化和艺术界两极化,以及不负责任的态度等。
  部长检察官全俊喆表示,“被告人被选为总统,却为了幕后实权人物的利益将国民委任的权限私有化,垄断国家政治并破坏宪法价值”,“成为韩国宪政史上首位遭到弹劾而被罢免的总统”。
  报道称,全俊喆还指出,“作为韩国国内最高政治权力者,被告人在密室中秘密会见最高经济权力者,要求对方提供经济利益,并承诺将对与经营权直接相关问题予以支持的行为属于典型的政经勾结”。全俊喆称审判部门还应该考虑到被告人有关“设定‘政治报复’框架,掩盖干政事件真相并歪曲事实真相,以及批评检方、特别检察官乃至司法部”的行为。
  在此基础上,检方要求判处朴槿惠有期徒刑30年并处罚金1185亿韩元,该金额是其所收受贿赂592亿韩元的两倍。
  4小时16分钟的辩护 律师请求宽大处理
  此前,朴槿惠拒绝出席庭审并辞退了律师团。对此,日审判部门选定了赵显权及南贤佑(均为音译)等为国家法律援助律师。据悉,朴槿惠从未接见过这些律师,但他们在包括休庭在内的4小时16分钟内,一直在为其辩护。
  在检方求刑后,第一个开始最终辩论的朴昇吉律师表示,“Mir和K体育财团捐款属于官民合作的事例,并非所谓胁迫或受贿”。朴昇吉律师回顾了自己观看平昌冬季奥运会开幕式的一个瞬间,表示“虽然犯下了错误,但请看在她作为总统曾夜以继日地付出过的努力,以及并没有为自己谋私利的做法上,对其予以宽大处理”。
  针对事关私营企业问题上的滥用职权、妨碍权力行使及胁迫等嫌疑进行辩护的金惠英律师也强调称,“没有事先阻拦亲信的错误行为,应当受到政治及道义上的批评,但是无法断定被告人确实做出了为没有血缘关系的崔顺实牟利的行为”。
  据主张三星受贿嫌疑无罪的姜哲求律师表示,“被告人如果在场,或许也会发表以下言论”,然后朗读了朴槿惠在日最后一次出庭时做出的包括“以法治为名的政治报复,希望能在我这里划上句号”等内容的发言。
  最后一个站起来的赵显权律师呼诉称,“在没有得到充分证明的情况下,即使怀疑被告人有罪,判决也应当考虑到被告人的利益。为了在日后的历史评价中能够得到不受舆论影响,作出了明智判断的评价,请审判部门进行仔细审查”。
  “40年知己”的同款重刑 朴槿惠在所难免?
  不过,韩媒认为,审判部门的判决或将与国家法律援助律师的期望大相径庭。
  朴槿惠主要涉嫌与崔顺实共谋向各大企业索贿774亿韩元,涉及亲信擅政的罪名指控共计18宗,其中15宗已在崔顺实、幕僚长金淇春等共犯受审时被认定共谋罪名成立,且崔顺实一审被判20年重刑。
  此外,青瓦台前秘书官郑虎成(音译)也因涉嫌泄露青瓦台文件被判处一年六个月有期徒刑。因此,多数舆论认为朴槿惠不可能会成为唯一的例外。
  据悉,法庭将于4月6日下午2点10分开庭公开审判朴槿惠。法庭表示,本案指控内容极其庞杂,证据关系各异多样,辩护争议较多,因此在宣判前留出充分的时间。

个人简介:江海洋,男,四川德阳人,博士,副教授,教育部2008年度新世纪优秀人才支持计划获得者。主要从事兽医药理学与毒理学方面的教学和科研工作。针对国内外食品安全,尤其是动物性食品安全的发展现状,先后在马杜霉素、磺胺类、喹诺酮类、替米考星、阿维菌素类等20余种兽药残留检测技术(快速筛选以及定量和确证分析)、药物代谢动力学、样品前处理技术、残留消除等方面取得了一些突破性进展。主持完成和参加科研项目近30项,包括十一五科技支撑项目、十五国家科技攻关计划、国家食品安全重大科技专项课题、国家自然科学基金重点项目、农业部残留专项及国家农业行业标准制定项目等。近5年在国内外科技学术刊物上发表论文60篇,其中SCI收录论文40篇;申请国家发明专利25项,其中10项获得授权;参与制定农业行业标准35项,其中18项已发布;2006年获得国家科学技术二等奖;2005年获得北京市科学技术一等奖;2001年获得北京市科学技术进步二等奖;获得5项省部级成果鉴定证书。
