您好，在驾校报名后因驾校长时间不安排考试，现在想退学，但驾校方表示要缴纳400元的违约金，而当时签订的合同中说明该合同为一式两份，甲乙双方各执一份，但驾校却并没有给学员另一份合同，请问该合同还有法律效用吗？PS:驾驶合同原文:“第十三条
本合同一式两份，甲乙双方各执一份，双方签字盖章即生效。”希望能帮我解答一下，谢谢！
